I have Apple TV 4K and while I find out the new release allowed infuse upscale only for the M1 and above does that mean I’m running Apple TVs upscaling, on the Apple TV ? and also I usually do 720 videos does it scale it up one notch to 1080 or am I actually getting 4K (I set up the Apple TV to display 4K) and will the new Apple TV is coming out this year be able to handle the infuse AI upscaling
The Apple TV currently uses our ‘Advanced Upscaling’ which was introduced a few years back provides pretty great scaling of lower resolution videos up to 4K.
Our ‘AI Upscaling’ features are available on newer devices and provide even better upscaling. Presumably these will be supported on the next gen Apple TV which is rumored to be released this year.

would it be possible to disable auto upscalling technique in infuse in Apple TV or any device, in case the video file is already in 4k and in HDR / Dolby vision format ?
If the file is already 4K then there would be no upscaling applied.
The same applies if you are playing a 1080p file and the video output is set to 1080p.
